TEXAS WRONGFUL DEATH STATUTES

This is written to provide general information to the lay public about this complicated area of the law. A deliberate effort has been made to keep the topic non-technical. If you or someone you know is in need of a Houston Wrongful Death attorney, immediately consult an attorney familiar with these kinds of claims for more detailed and technical information.

In Harris County, Texas people are killed in car wrecks daily. The preliminary data from the Department of Public Safety for 2007 indicates that there were 401 fatalities in vehicle accidents in Harris County. These fatalities occur in crashes that happen in every imaginable way from single vehicle, to multi-vehicle, to pedestrian and motorcycle crashes. When someone dies as a result of the negligent driving of another, the damage claims that Texas laws provide to their loved ones and heirs come under the Texas Wrongful Death Statutes and the Texas Survival Statute.

The Wrongful Death Statutes allow the parents, spouse and children of the deceased to recover specified damages for the loss of their loved one. The Survival Statute allows the estate of the deceased to recover for the pain and mental anguish suffered by the deceased, along with his/her last medical expenses and funeral expenses.

The way that these cases are reported in the media make it sound like the loved ones of a person killed in a traffic accident receive a lump sum of money. It doesn’t work that way. Damages in these cases are condensed into very specific areas. Though most of these cases will settle, the way a Houston Wrongful Death attorney evaluates the damages in a given case is to look at the specific damage questions that a jury would be required to answer if the case were to go to trial. Each area of damages must be supported by facts. It is not enough to say that a wife loved her husband, who was killed in a traffic accident. Juries need details about the quality and nature of their relationship.
