STEP 4: IDENTIFY IMPORTANT DEADLINES

THE STATUE OF LIMITATIONS: There is a 2 year statute of limitations that applies to most personal injury cases in Texas. This means that before the second anniversary of the accident, the case must either be settled or a lawsuit must be filed.  Otherwise the right to sue is lost. In most cases it is not necessary to file a lawsuit immediately, and the plaintiff has time to develop the case and hopefully finish  medical treatment for his/her injuries. Sometimes an early lawsuit is necessary in order to develop and preserve important evidence.

TORT CLAIMS ACTS: Any time a governmental unit is sued, the plaintiff must meet special notification requirements and deadlines. Usually the prescribed time period for the notification is 6 months, but sometimes the prescribed time period is shorter. If the proper notification is not given within the prescribed time period, then the case is waived. We meet these deadlines.

LITIGATION DEADLINES: Once a lawsuit is filed many deadlines are imposed on the case. Some of these deadlines are found in the Texas Rules of Civil Procedure (TRCP), some are local deadlines required by the county in which the case is pending; and most often they are rules imposed by the specific court in which the case is pending. We have a sophisticated calendar program that helps us keep up with all applicable deadlines.
