While I am investigating the liability facts and the applicable law, I also investigate what insurance policies are available and the amounts of the coverage.
In a car wreck case, the obvious insurance policy to look for is the one on the defendant’s vehicle. But other sources of insurance coverage must be explored as well. For example, was the defendant in the course and scope of employment at the time of the collision? If so, that could bring a company insurance policy into play. Was the defendant driving someone else’s vehicle? If so, the driver may have his own policy that may add to the amount of coverage. Every potential avenue for insurance coverage must be explored.
One problem is that the insurance company is not required to tell me how much insurance coverage there is, unless I file a lawsuit. We know that currently, minimum limits of insurance coverage for car wrecks in Texas are $25,000 per person and $50,000 per incident. This means no one person can receive more that $25,000 for their injuries and no matter how many people are making claims; the most that the insurance company must pay for all claims is $50,000. Some people purchase higher limits of insurance coverage and in cases with serious injuries, those higher limits must be discovered and accessed.
If the plaintiff has a lot of medical bills and other damages it is important to determine the amount of available coverage. Usually I can get the insurance company to disclose the amount of coverage on the insurance policy. If the insurance company refuses, sometimes it is necessary to file a lawsuit to discover the amount of the coverage and other details about the applicable policy.
