A successful case requires the plaintiff to establish that the negligence of the defendant proximately caused the plaintiff’s injuries and damages. This is accomplished by a thorough investigation of all the liability facts along with an analysis of how the facts of the case fit into the applicable law. Every case is different and each case must be carefully evaluated on its own merits.
 
One of the advantages I have in this process is that my skills in developing and presenting liability issues are not just theoretical but courtroom tested. I have tried these kinds of issues over and over to real juries in real courtrooms. When an adjuster makes an unreasonable argument, I either get them to back off; or if my client approves, I file a lawsuit that takes the case out of the adjuster’s hands and puts it into the hands of a jury.

Effectively gathering and presenting the liability facts is an important step toward bringing the case to a successful conclusion. Usually the case will settle because the insurance company can see the strength of our position. In those cases where the insurance company continues to be unreasonable, we file our lawsuit and take it to a jury.
