STEP 9: ORGANIZATION, DOCUMENTATION & DEMAND
  • We gather all documents and information that support the plaintiff’s case
  • We identify all parties who have a legal interest in the plaintiff’s recovery, such as the subrogation representatives for the health insurance provider
  • We contact t hese interested parties and, when possible, negotiate their claims down
  • We prepare a demand letter with supporting documentation that serves as a blueprint of the plaintiff’s case.

In my office, from the first day of representation, we begin to assemble the documents and other information that will provide a clear and convincing picture of the claim to the insurance company. Regarding the liability issues this can include the police report, witness statements, photographs and any other information that has been developed to support the plaintiff’s perspective of the accident. Regarding the damage issues we gather medical records, medical bills, copies of diagnostic studies and all of the documentation necessary to support the plaintiff’s damages.

Also, we identify all of the parties who have a legal interest in any recovery made by the plaintiff. Examples of interested parties include health insurance companies with subrogation interest, hospitals with liens; or doctors with outstanding balances. Whenever possible, we negotiate their interests down and put these agreements into writing.

All of the pieces of the plaintiff’s case are presented in a documented demand letter that provides a kind of blueprint of the case to the insurance adjuster. The purpose of this demand letter is to convince the adjuster that the plaintiff has a valid legal claim with legitimate damages that require compensation. If the insurance company refuses to make a fair settlement offer, then the demand package becomes the blueprint for filing the lawsuit and preparing for trial.
