The best way to prepare a Houston personal injury case for settlement is to have the trial experience necessary to anticipate the way a jury would likely see the important facts. Most well-prepared personal injury cases will settle. After we thoroughly investigate and document the case and identify and negotiate agreements with all of the ancillary parties, such as the health care providers with outstanding balances and liens , then we can analyze the range of values and the strengths and weaknesses of the case and begin the negotiations with the insurance adjuster. If the adjuster makes a fair offer that my client approves, then the case settles.

Most cases that go into a lawsuit will settle before the time of trial. Sometimes it is necessary to file a lawsuit in order to develop and preserve evidence that cannot be obtained without filing a lawsuit. Sometimes it is necessary to file a lawsuit because the insurance adjuster has taken a negative position about the case. F iling a lawsuit takes the case out of the hands of the insurance adjuster and puts it into the hands of a defense lawyer who may be more realistic about it. 

Trials occur in situations where the parties disagree about important issues in the case and cannot work out a compromise. Juries are called the fact finders. This means that the facts that are in disagreement between the parties are submitted to the jury and then the jury answers special “questions” that say who wins and who loses.  My extensive experience in presenting cases to juries enables me to obtain favorable settlements and verdicts for my clients.
